2. What is U.S. EB3 Immigration? How many Types?

The EB3 program is a legal immigration program established by the U.S. government in the 1990s, allowing workers to be sponsored and assigned by a U.S. employer to work in the United States.

This program provides a green card directly for 10 years, allowing the worker to bring their family, including a spouse and unmarried children under 21, to settle in the U.S.

EB3 is the third preference of employment-based immigration visas in the United States. It is designed for three types of applicants: Professionals, Skilled Workers, and Unskilled Workers. You may qualify for an EB3 visa if you meet the requirements for one of these categories. The U.S. Citizenship and Immigration Services (USCIS) defines each category as follows:

  • EB3 Professional: Individuals with advanced degrees and professional licenses required for their jobs, such as professors, doctors, pharmacists, accountants, physical therapists, and designers.
  • EB3 Skilled Workers: Workers with at least 2 years of experience in their specialized field, such as chefs, estheticians, tailors, auto mechanics, and marketing specialists.
  • EB3 Unskilled Workers: Workers who can perform tasks that do not require specific skills or prior experience. This is also a common choice for many international students from Vietnam who wish to stay in the U.S. after studying. Unskilled workers are employed in roles such as hotel housekeeping, waitstaff, kitchen assistants, factory workers, packaging workers, and caregivers…, often at minimum wage.

3. Conditions for Applying for EB3 Employment-Based Immigration Jobs

International students on an F1 visa and visitors with a B1/B2 visa must meet certain basic conditions to apply for EB3 employment-based immigration in the U.S. The requirements include:

  • Valid F1 or B1/B2 Visa
  • Have no criminal history or convictions.
  • Should not have previously been denied a green card or have a history of illegal residency in the U.S.
  • Be in good health and capable of working for the employer for a continuous period of at least one year.
  • No prior work experience is needed, making this ideal for recent graduates on an F1 visa who are just starting their careers.
